Terms of Service

1. Acceptance of Terms

By accessing or using the eMentor platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and eMentor Education Technology JSC ("eMentor", "we", "us").

We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email or through a notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.

2. User Accounts

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

You must be at least 13 years of age to create an account. Users under 16 must have verifiable parental or guardian consent in accordance with Vietnamese Decree 13/2023/ND-CP on personal data protection. We may suspend or terminate accounts that provide false information or violate these Terms.

3. Course Access & Licensing

Upon successful enrollment and payment, eMentor grants you a limited, non-exclusive, non-transferable license to access and use the course materials for your personal, non-commercial educational purposes. This license does not include the right to reproduce, distribute, or create derivative works from any course content.

Course access is tied to the enrollment period specified at the time of purchase. IELTS preparation courses include a 6-month access window; Business English courses include 12 months. Extensions may be purchased separately. Access to live mentoring sessions is subject to availability and scheduling.

4. Payment Terms

All course fees are quoted in Vietnamese Dong (VND) and are inclusive of applicable taxes unless stated otherwise. Payment is required in full at the time of enrollment unless you have selected an approved installment plan. We accept payments via credit/debit cards, bank transfer, MoMo, ZaloPay, and VNPay.

Refund requests must be submitted within 7 days of enrollment and before completing more than 20% of the course content. Refunds will be processed within 10 business days to the original payment method. Promotional pricing and discount codes cannot be applied retroactively or combined with other offers.

5. User Conduct

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service. Prohibited conduct includes but is not limited to: sharing account credentials, uploading malicious content, attempting to gain unauthorized access to other accounts or systems, and using automated tools to scrape or download course materials.

You may not record, screenshot, or otherwise capture live session content without the explicit consent of the instructor and all participants. Harassment, hate speech, or discriminatory behavior toward instructors, fellow students, or staff will result in immediate account suspension.

6. Intellectual Property

All content on the eMentor platform, including but not limited to text, graphics, logos, video lessons, audio recordings, assessments, and software, is the property of eMentor or its licensors and is protected by Vietnamese and international copyright, trademark, and other intellectual property laws.

User-generated content, such as forum posts and assignment submissions, remains your intellectual property. By submitting such content, you grant eMentor a non-exclusive, royalty-free license to use, display, and distribute it within the platform for educational purposes.

7. Limitation of Liability

To the maximum extent permitted by Vietnamese law, eMentor shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to eMentor in the 12 months preceding the claim.

While we strive to ensure uninterrupted access to the Service, we do not guarantee that the platform will be available at all times. Scheduled maintenance windows will be communicated in advance when possible.

8. Termination

You may terminate your account at any time by contacting our support team. eMentor reserves the right to suspend or terminate your access to the Service at our discretion, with or without cause, including for violation of these Terms. Upon termination, your right to access the Service and any course materials ceases immediately.

Sections of these Terms that by their nature should survive termination—including intellectual property, limitation of liability, and governing law—will remain in effect after your account is closed.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Socialist Republic of Vietnam. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in Ho Chi Minh City, Vietnam, unless otherwise required by applicable consumer protection regulations.

Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation within 30 days of written notice of the dispute.
